The less obvious rules that can change your Eastside custom home
A lot can pass the basic size test and still need a different design. Compare critical areas, protected buffers and less obvious restrictions before paying a premium for land or committing to a floor plan.
Start with the part of your design you will not compromise.
Wide home or single-level living
Test usable width, coverage, roots and access. A large FAR budget does not guarantee a large ground floor.
Tall rooms, roof decks or a view
Test grade, roof measurement, upper-floor setbacks and neighboring development before drawing the elevations.
Basement, pool or large garage
Check counted floor area, excavation, groundwater, drainage and outdoor surfaces together. Space underground is not automatically exempt.
One design issue to investigate in each city
These are useful differences to investigate, not claims that the issue exists only in that city. The detailed city guides explain the related rules and exceptions.
Bellevue
A downhill wall can fail a separate height test
Overall height uses average existing grade, but an individual facade generally also has a 40 ft cap. On a corner lot, two public streets require two front yards. A private access easement follows different rules.
Before an offer: Have the architect show all facade heights, classified frontages and the garage within the FAR calculation.

RS and RSX are not interchangeable
A nearby house in RSX does not establish the height allowed on an RS parcel. Average building elevation also depends on the proposed footprint. Test the roof and lower level with surveyed grades.

Original grade can matter more than today's ground level
Clyde Hill's original-grade reference is tied to March 1953 conditions. Fill does not automatically create more height. Small-lot upper-story angle planes can narrow the second floor even where the ground floor fits.
Before an offer: Get the City's original-grade determination and draw roof and upper-story sections before relying on a two-story concept.

The upper floor may need to sit farther in
Side yards increase for the upper story and can depend on lot width. The Medina Heights overlay is a separate constraint. Interim Ordinance 1059 continues temporary bulk controls, so confirm the applicable ordinance when buying.
Before an offer: Request a written zoning and overlay check, current interim rules and separate lower- and upper-floor envelopes.

Slope can directly reduce the coverage budget
Coverage decreases as average lot slope increases. Net lot area and width-based side yards can reduce the result again. An exposed lower level can also change how much floor area is counted.
Before an offer: Have a surveyor establish slope, net area and lot width. Ask for both coverage and gross-floor-area calculations.

A larger lot does not erase the one-dwelling floor-area cap
A large NR lot still has the one-dwelling total GFA cap. Adding a basement does not sidestep it. Confirm the current NR designation rather than relying on a former R-zone name in a listing.
Before an offer: Have the architect count all structures and below-grade space against the current dwelling-count cap.

The house setback may not work for the garage
Parking structures need a 20 ft setback from streets and access tracts even where the house has a smaller front yard. That can change driveway length and the hard-surface budget.

A compact lot has several independent size tests
GFAR and the maximum structure-area cap include more than living space. Roof and perimeter-face controls add another check to the 30 ft height limit.
Before an offer: Include the garage, covered spaces and outbuildings in the first massing study. Confirm the designated front and rear yards.

Angle planes can narrow the upper story
Original and finished grade caps work alongside 45-degree side-yard angle planes. Waterfront yards use additional rules. The maximum height is not a box that can be filled to every setback line.

The residential district changes the surface budget
A large SF-E lot and an SF-S lot have different impervious percentages and yards. A steep or buffered portion of either parcel may not work for the house, access or drainage.
Before an offer: Confirm the zone and subarea. Ask for an impervious-surface schedule with the driveway included, not only the roof.

Permeable paving is not a universal coverage exemption
The code separates building, hard-surface and impervious limits. Surface adjustments have conditions. A critical-area tract or buffer can also require an additional building setback.
Before an offer: Have the civil engineer classify every proposed surface and show the critical-area building setback separately.

A bigger house can trigger bigger yards
R-4 and R-6 use building-area thresholds at 2,500 and 4,000 sq ft. Steep sites also have a segmented grade method. Test the intended house size, not the smaller home currently on the property.
Before an offer: Ask the architect which building-area tier applies and whether a smaller or stepped design changes the envelope.

A lane or shoreline changes the ordinary setback picture
A private lane is not simply an interior boundary. Waterfront, panhandle and between-dwelling distances can add limits to the basic yards. Height must satisfy original and finished grade tests.
Before an offer: Have the survey label lanes, shoreline and access rights. Confirm each setback before testing the footprint.

More land can come with a lower coverage percentage
Building coverage is tied to actual lot size as well as zone. A large R-1 parcel does not get the same percentage as a small lot. Landscaping, trees and drainage need their own space.
Before an offer: Verify municipal jurisdiction, current zone and the actual lot-area coverage tier before multiplying acreage by a percentage.

Washington protects wetlands, fish and wildlife habitat, geologic hazards, frequently flooded areas and critical aquifer recharge areas. Not every category creates the same kind of restriction. A wetland can require a protected buffer. A geologic hazard can require engineering and siting changes. A recharge area can impose groundwater protection standards.
1. Locate the actual feature
Use city and county GIS to identify questions. Then obtain field confirmation where needed. A wetland or slope on neighboring land can affect your lot. A blank map is not a finding that the site is clear.
2. Draw the protected space
Show the feature, required buffer and any additional building setback as separate lines. Buffers can protect vegetation and habitat as well as keep structures away. A buffer is not simply spare yard.
3. Test the whole project
Fit the house, driveway, utilities, drainage and construction access together. Check counted floor area and coverage separately. A lot can pass the numerical zoning test but fail the physical fit test.

Compare the treatment, not one universal buffer number.
Wetland category, habitat score, stream type, slope conditions and shoreline jurisdiction can change the answer within a single city. These are selected differences for a buyer to investigate. They are not a complete buffer schedule or a ranking of which city is easiest.

Can an engineer or mitigation plan make the restriction go away?
Not automatically. Mitigation review starts with avoiding impacts, then reducing and addressing unavoidable impacts. Paying for replacement planting or a report is not permission to build in a protected area. An approved plan can also carry monitoring, maintenance and financial security obligations.
Buffer averaging is a controlled change in shape, not a blanket reduction in protected area. Kirkland, for example, requires its averaging criteria to be met. A reasonable use exception has its own stringent criteria. Do not value a lot as if an exception will deliver your preferred house size.
Ask for a critical area due diligence package.
- Survey and environmental boundaries. Get a topographic survey, wetland delineation or stream assessment where relevant, and a plan showing on-site and nearby features, buffers and building setbacks.
- The right specialist reports. Ask Planning which reports are needed. These may include a biologist's critical area report, geotechnical engineering, civil drainage analysis, flood evaluation or groundwater assessment. An arborist report does not replace wetland or geologic review.
- Existing records and obligations. Obtain prior studies, permit decisions, mitigation plans, monitoring reports, protected tracts and title notices. Ask whether old reports remain acceptable for this proposal under current rules.
- A compliant concept and an approval list. Have the architect test a design without discretionary buffer relief first. Identify city, shoreline and any applicable state or federal approvals before relying on a more ambitious alternative.
- Cost and schedule exposure. Get project-specific estimates for study work, independent review, drainage, foundations, mitigation and ongoing care. Check whether seasonal fieldwork or construction restrictions affect the purchase timeline.
Our buying take: Compare the cost of a house that fits the confirmed constraints, not the seller's maximum square footage claim. If the purchase only works with a buffer exception, leave time to resolve that risk before committing.
Other site and private restrictions
Review these alongside critical areas. They can remove usable land or add costs even when the zoning table looks generous.

Use the same short brief for every lot.
- Define the house. List target living area, garage size, floors, ceiling heights, outdoor spaces, ADU plans and essential views.
- Confirm jurisdiction and zoning. Include overlays, pending ordinances, housing type and private restrictions.
- Draw a preliminary site fit. Show footprint, height, counted floor area, trees, buffers, access and drainage on one plan.
- Price the unresolved work. Ask your team to distinguish documented constraints, assumptions and items that need city confirmation. Compare total project cost, not land price alone.
- Resolve deal breakers before commitment. Work with your agent and attorney on due diligence timing. Do not treat a variance, neighbor agreement or tree-removal exception as guaranteed.

Turn a mapped warning into a decision about the site
A wetland or steep-slope layer near the rear boundary may affect more than the house footprint. Access, utilities, grading, drainage discharge and construction staging may also reach a regulated area or buffer. A map with no highlighted feature is not a field determination that no feature exists.
- Screen
- Save the parcel, layer name, map date and nearby features, including those just outside the property. Check the City's own map as well as county data.
- Investigate
- Ask the appropriate wetland scientist, geotechnical engineer or other qualified specialist which field work and report the City requires. A geotechnical report does not replace a wetland delineation.
- Test a concept
- Draw the professionally identified areas, buffers, building setbacks and full disturbance limits together. Test a smaller footprint or alternate access before pursuing an exception.
- Decide
- Obtain a written scope, likely approval path and unresolved questions before fixing the purchase or design budget.
Do not add several buffer widths blindly or assume one exception solves every overlay. Ask staff which boundaries and rules apply together. Any reduction or alteration path must be evaluated under that jurisdiction's current criteria.
